Majority Rule vs. Inalienable Rights: The Republic and The NYC Muslim Community Center

The current debate over the so-called “World Trade Center Mosque” is an unfortunate attempt at creating a wedge-issue for the up-coming Mid-Term election.  However, it is also a great opportunity to talk about what our Constitution stands for, what the inalienable rights of a Republic mean, and how a majority (mob) ruled Democracy is not the form of government we wish to have in our country.

In our Republic, our Rights are not given to us by the Majority or by the Government.  They are not even given to us by our Constitution, they are acknowledged by our Constitution as Inalienable Rights given to us by our Creator; whether that means God, Allah, Mother Nature or Your Mother and Father.  This is a spiritual statement, written in Law.

The often sited “majority of Americans” that oppose the Community Center is inconsequential to whether or not the builders of the Center have the Right to do so.  We are not a country of mob-rule.  Even if 99.9% of Americans oppose the Community Center, the Rule of Law; the Inalienable Rights referred to by the Constitution, protects both the Religious Freedom of the group building the Center, and the Property Rights of the owners and leasers of the property. The Community Center was approved by the City’s Zoning Laws.  Whether or not you as an Individual, or the Majority of Americans, oppose the building of a Muslim Community Center near Ground Zero, it has no barring on whether or not they can.  If we wish to progress as a Nation, and if we wish to secure our Form of Government, we must tolerate the building of this Community Center, and if we as Individuals wish to progress as a spiritual and social beings, we must embrace and cherish the building of this Community Center.
